TiVo (TIVO) Rockets Up on Court Ruling Concerning (DISH)

Shares of TiVo (NASDAQ:TIVO) are soaring while those of Dish Network (NASDAQ:DISH) are under pressure after a ruling from the U.S. Court of Appeals for the Federal Circuit in Washington that Dish was in contempt of a court order issued in 2010.

The court ruled that the continual running of the DVR service Dish provides to its subscribers violates the order.

TiVo said the ruling, “paves the way for TiVo to receive substantial damages and contempt sanctions regarding the DVRs that EchoStar and Dish Network failed to disable.”

The court did reject a ruling that Dish’s software “workaround” was insufficient to avoid infringement. That means it'll get another look from a court.

Dish said it will take its case to the Supreme Court if it has to concerning being able to continue its DVR service.

TiVo was trading at $11.27, gaining $2.90, or 34.65 percent, as of 2:35 PM EDT. Dish was trading at $23.62, down $0.25, or 1.05 percent.

JPMorgan (JPM) (BBY) (TIV) (KR) (WAG) Victims of Email Theft

A number of bank and businesses have had their emails and names of customers stolen by hackers, including JPMorgan (NYSE:JPM), Best Buy (NYSE:BBY), TIVO (NASDAQ:TIV)), Kroger (NYSE:KR), Walgreen (NYSE:WAG), Citigroup (NYSE:C), U.S. Bancorp (NYSE:USB), Barclays (NYSE:BCS and Capital One Financial (NYSE:COF).

Epsilon, a division of Alliance Data Systems Corp., was the company which has been apparently hacked, with the probable theft of million in emails of the companies mentioned above, and others.

Other private information wasn't attained, according to Epsilon, but companies have been sending out warnings to their customers to be wary from emails claiming to be from them which ask for personal information which could be used to extract money from their accounts; a tactic called "phishing."

Normally this scheme involves the hackers to set up a site made to look like the site of a bank and then get them to log in using their user name and password, which they then can use to access the account itself.

H&R Block (HRB), TiVo (TIVO) Attract Option Bulls

Option traders have been bullish on H&R Block (NYSE:HRB) and TiVo (NASDAQ:TIVO), betting the shares will go up in the short term.

With markets taking a breather from oil worries, options traders staged big bullish earnings bets on tax preparer H&R Block and revisited long-running legal disputes over digital video recorders with TiVo.

Bullish H&R Block contracts changed hands at the heaviest pace in three months. In an echo of the optimistic pre-earnings bets that dominated trading early this year, traders had a preference for high-risk March call options that require a big and nearly immediate jump in the stock to show a profit. H&R Block reports earnings Wednesday after the close.

"Whenever you see people buying cheap [call] options with only a few days remaining, it's extremely bullish," said TradeKing senior options analyst Brian Overby.

Tuesday's action focused on March $16 calls to buy H&R Block's stock, contracts that expire a week from Friday. The tax-preparation company's shares were up 55 cents, or 3.8%, at $15.02 at 4 p.m. on the New York Stock Exchange.

TiVo was another draw for bullish traders who, in this case, played the contrarian as more litigation news weighed on the stock.

The company said it plans a convertible debt offering, in part to fund its legal battles, saying Microsoft filed a patent-infringement lawsuit and a complaint with the U.S. International Trade Commission. The company is already in a lengthy court dispute with rivals Dish Network and EchoStar.

TiVo closed at $8.75, down $0.31, or 3.42 percent. H&R Block closed at $15.02, gaining $0.55, or 3.80 percent.

TiVo's 4Q Losses Triple Over Last Year

TiVo Inc. said Tuesday that its fiscal fourth-quarter net loss more than tripled after the company sold steeply discounted digital video recorder set-top boxes during the holiday season and racked up legal fees in a series of patent disputes.

The Alviso, Calif., company also forecast a larger-than-expected loss for the current quarter.

TiVo lost $34.4 million, or 30 cents a share, in the period ended Jan. 31. That compares with a year-earlier loss of $10 million, or 9 cents a share.

Revenue fell 19 percent to $55.8 million from $68.7 million.

Analysts, on average, expected a loss of 28 cents per share on $51.1 million in revenue, according to FactSet.

TiVo (TIVO) Sued by Motorola (MMI) DVR Patents

TiVo Inc. (NASDAQ:TIVO) is the recipient of a lawsuit from Motorola Mobility Holdings Inc. (NYSE:MMI), which claims Motorola invented digital video recording technology before Tivo.

Motorola is also seeking to find out if Verizon Communications (NYSE:VZ) is using TiVo technology in its set-top boxes.

Motorola said in the lawsuit, “The TiVo patents disclose and claim the same technology that Imedia engineers invented years before. TiVo obtained patents on its DVR product and sued the industry.”

Verizon was sued by Tivo in 2009 in connection with Verizon's FiOS televison service allegedly violating DVR patents.

Microsoft (Nasdaq:MSFT) Files Trade Complaint Against TiVo (Nasdaq:TIVO)

With companies looking for new sources of revenue, a growing number have filed complaints or lawsuits against competitors for infringing on their patents, with Microsoft (Nasdaq:MSFT) being the latest, alleging TiVo (Nasdaq:TIVO) infringed on four of their patents.

Canaccord says, "Not to be outdone by Kodak (NYSE:EK), Mr. Softie has filed a trade complaint against TiVo, accusing the television company of infringing four of its patents. The complaint alleges that Microsoft’s Mediaroom software platform, which allows “TV and video service providers to deliver enhanced entertainment content and applications to their subscribers”, and is licensed to companies such as AT&T (NYSE:T), relies on intellectual property violated by TiVo. Specifically, the tech giant complains TiVo's digital video recorder (DVR) technology infringes patents relating to program schedules and selection, user interface controls, and content restrictions based on program ratings. As a result, Microsoft is asking the U.S. International Trade Commission (ITC) to stop TiVo from importing its DVRs into the U.S. “Microsoft seeks an order excluding TiVo’s infringing set-top boxes and associated software and hardware from entry into the United States,” reads the January 24 complaint, “and a cease and desist order or orders halting the domestic sale of infringing, imported set-top boxes and associated software and hardware.” Notwithstanding the merit of Microsoft's claim, analysts say it is unlikely the ITC would award such an injunction. While Microsoft has certainly elevated the issue, it may be jockeying for position rather than looking for a result: discussions between the companies are ongoing, and the two are committed to finding a common solution. “We remain open to resolving this situation through an intellectual property licensing agreement, and we look forward to continued negotiations with TiVo,” said one Microsoft spokesperson."

Microsoft closed Wednesday at $28.78, gaining $0.33, or 1.16 percent. TiVo closed at $9.75, losing $0.12, or 1.24 percent.
